A better way to think of it is <$250k 50% of the profit is tax-free. >$250k only 34% of it is tax exempt.
First, the bump to 66% only happens after 250k that year so $25k would not trigger the extra 16% eligibility. So standard 50% CG only would be applied. $12.5k taxed at your rate means the min rate which may be something like 20% (this number is a wild guess) so say $2500 paid to the gov. Not as bad as it sounds.

No, IP should absolutely have some protections. Invent a hot new thing and giant-corp immediately out markets and produces you into oblivion. With zero protections innovation would be completely stamped out. Totally gone, not just harmed. No more new things because it would be immediately stolen so why bother.
That said, current IP laws are absolute BS and need to be cut back tenfold. None of this century of protection BS. For the lifetime of the creator, non-transferable. You can sell rights to use it but you cannot relinquish your ownership and creator status. Those are my hills but I’m not willing to die on them either.
He was already 2 years in to a 3 year contract when the 5 year law came into effect. Renewed for 3 more = 3 + 1, then 1 month shy of 2 more = <5+1. I believe the reason is his total employed period actually exceeded 5 years if you consider the portion that partially overlapped at the start of the law.
